p828 thru p830 summary: Judy McLaughlin affidavits of 17 February 1848 and 10 June 1858 by Judith McLaughlin, widow of John, deceased, late of Tazewell County, VA. She knows that few persons spell the name McLaughlin, as it is commonly spelled McGlothlin or McGlathlin. For example, in the 6th pension census in 1840, the Marshall spelled her husband's name McGlotholin using two "o's" - but that her surname in her husband's pension application declaration being spelled McGlathlin or McGlothlin arose from the fact that few persons spell the name the same way. Judith explicitly stated in her affidavit that those who prepared the pension application affidavits for him were not familiar with the correct spelling, which is McLAUGHLIN. She stated that long term neighbors of theirs were George Steele, James Kindrick and John Brown.

State of Virginia Tazewell County On this twentyth day of November 1832 personally appeared John McLaughlin in open court before the Justices of the County of Tazwell aforsaid, it being account of service having sworn to fine and imprison on a ///////// assurance of all its proceedings, a resident of said county of Tazewell and state of Virginia aged he thinks seventy six years on the 26th day of January next, who being first -- duly sworn according to law, doth on his oath make the following declaration, in order ot obtain the benefit of the act of Congress passed June 7th 1832. That he enlisted in the army of the united States he thinks about the year 1778 or 1779 under Capt Michael Dickson, Lieutenant William Henderson, for the term of three years or during the war, that he served under different officers, and was attached to different regiments during his term of service, he served a part of his time under Col Samuel Doak, and a part of the time under General Sumpter, also General Green who was the commander in Chief, that he served the full term of three years and was discharged at Guilford in North Carolina and received a written discharge but from whom he does not now recollect, which has been lost by time and accident so that it cannot be sent forward. That at the time of his enlistment he was a citizen of Mechlinburg County in the state of North Carolina on Crooked Creek, that he marched to the frontiers of Georgia to Rogers Fort, where he remained about one year perhaps more, on Ogichaw river, from whence he was marched to Agusta on Svanah river, when he remained a short time, when the troops received order to Go to Brian Bank Bridge, where they marched, and that he was in the battle fought there with the British & Tories, at what time it was fought his memory does not at this late date serve him. From there he was marched to Ironsberg where he was stationed some time, but the precise time he cannot at present state; From there he marched to Augusta Castle, or perhaps he marched to Savannah first where they had a battle with the British, and there he then received a wound in the right nee, the ball passing through the fleshy part of the leg a small distance above the nee, which at this day is occasionally very painful to him, From there he was removed he thinks to a place called Midway where he remained until he was able to do duty again, and joined the army again on the South side of Savanah in or near George Golfins and from there he was marched towards Augustine to Stone Brown Fort who was stationed there, but owning to some delay in consigns of the some of the baggage horses having been hamstringed by the Tories, the Fort was burnt down by Brown himself often hiding other munitions of was it contained in different places, before he got thru, they found large quantities of arms, Blankets, rum,wine, and many other articles, which they had hid in different places; From there he crossed the Savanah river and came over into the South state, for the purpose of assisting General Gates, but before he arrived to his relief the battle was fought, and he was defeated from them then he was marched to a place called the Ram Parts, and was in the battle fought there with the British and Tories. From there he was marched to a place called Whitsels mill in the state of North Carolina, where he was in the battle fought there, with the Tories and British, From there he was marched to a place called Rocky Mount where he was in a small scrimmage. And from there he was marched to Guilford, where he arrived a short time after the battle of Guilford, and was there discharged as above stated. That he has no record of his age that he can resort to at this time. That after his discharge he went to Cumberland county in North Carolina, where he resided about three or four years, From there he removed into Randolph County in the state of North Carolina where he remained several years, From there he removed onto Patrick County Virginia, and from there he removed to the Western Country in the neighborhood as where his now, and has ever since resided, He hereby relinquished every claim whatever to a pension or annuity except the present and he declares that his name is not on the pension role of any agency in any state of listing whatsoever. State of Virginia Tazewell County On this twentyth day of November 1832, John Bruit (?) appeared in open court and after being duly sworn according to law, states that he is well acquainted with John McLaughlin who has subscribed and sworn to the above declaration; and that he believes him to be of the age of seventy six years, as he states, that he saw him in the service of the United States as a regular soldier, both in the state of South and North Carolina, and that he saw him while he was wounded and before he got well, his wound was in the right leg above the nee, the he saw him in //////////// in the following years to wit, 1788 - 1789 - 1781. The following is a statement of your case in a tabular form. On comparing these papers with the following rules, and the subjoined notes, you will readily perceive that objections exist, which must be removed, before a pension can be allowed. The notes and the regulations will shew what is necessary to be done. Those points to which your attention is more particularly directed, you will find marked in the margin with a brace, (thus: } ). You will, when you return your papers to this Department, send this printed letter with them; and you will, by complying with this request, greatly facilitate the investigation of your claim.

State of Virginia Tazewell County On this 3rd day of February AD 1858 Personally appeared before me a Justice of the Peace within and for the County and State aforesaid Judy McGlothlin a resident of Russell County and State of Virginia aged ninty five years who being first duly Sworn according to law doth on her oath make the following declaration in order to obtain the benefits of the provision made by the act of Congress passed on the 29th day of July AD 1848 Granting pensions to the widows of persons who served during the Revolutionary war that she is the widow of John McGlothlin deceased a Soldier of the Revolution and a pensioner of the United States his name being inscribed on the pension Rolls of the Virginia agency for paying pensions at the rate of Eighty dollars per annum. She further States that She was married to the Said John McGlothlin in the State of South Carolina on or abut the first of April AD 1783 by one William Grimes a minister of the Gospel that her name before her Said marriage was Judy Leathers That She was married by publishing the Bans of Marriage and if any record Exists as to her marriage She Dont know where to find it. That from old age and the Consequent loss of memory She Cannot recolect the County She was married in That her Said husband died at his residence in Tazewell County State of Virginia on the 17th day of February AD 1848 and that She is now a widow having never intermarried Since the death of her aforesaid husband That from old age and bodily infirmity She is unabel to attend in Court to make her declaration.

She begs that the department may look over he informal declaration and respectfully refers to the evidence filed in her Said husbands declaration in Suport of her claim. State of Virginia Tazewell County )) On this 5th day of February AD 1858 personally appeared before me a Justice of the peace within and for rthe county and State aforesaid Jacob McGlothlin ad resident of Russell County aged 67 years who being duly sworn according to law States on his oath that he is the third child in decent of John McGlothlin and Judy McGlothlin the within applicant for pension and from his Earlist recollection they lived together as man and wife up to the period of the Said John McGlothlins death that they raised a large family of children thirteen in number the Eldest of which if living would now be Seventy three years of age that this affiant was now Sixty Seven years of age That his mother Since his fathers death has lived with her children in Tazewell and Russell Counties in the State of Virginia That he father the Said John McGlothlin died at his residence in Tazewell County State of Virginia on the 17th day of February 1848 and that his mother Judy McGlothlin is now a widow. ss) Jacob McGlothlin (Seal)

State of Virginia Tazewell County On this 13th day of September AD 1858 personally appeared before me a Justice of the Peace within and for the County and State aforesaid Judith McLaughlin aged ninety five years a resident of Russell County in the State of Virginia - who being duly sworn according to law declares that She is the widow of John McLaughlin deceased who was a private in the Revolutionary war and a pensioner of the United States That her said Husband died at his residence in Tazewell County State of Virginia on the 17th day of February AD 1848 that She has not intermarried Since the death of her Said Husband But Still Continues the widow of the aforesaid John McLaughlin She makes this declaration for the purpose of obtaining the Bounty land to which She may be Entitled under the act approved March 3rd 1855 - She also declares that She has not recived a warrant for Bounty land under this or any other application therefor - She respectfully refers to the proof filed in the pension office in her declaration under which She now Receives a pension as the widow of the aforesaid John McLaughlin Dece in Suport of her Claim The Commissioner of pensions pleas Send my warrant when issued and all Communications to the Cear of Robert McLaughlin Esq of Richlands Tazewell Co Va Judith her X mark McLaughlin (Seal)
