Executed 02 Nov 1813

In the name of God Amen I Henry Fuller of the county of Russell and state of Virginia being sick and weak in body but of sound mind and desposing memory (for which I thank God) and calling to mind the uncertainty of time and life and being desirous to dispose of all such worldly estate as it hath pleased God to bless me with I give and bequeath the same in manner following that is to say.

1st I desire my just debts to be paid out of the money now in my possession.

2'dly after the payment of my debts - I give to my son John H. Fuller part of the tract of land which I now live on beginning at the mouth of my spring branch and running up the branch for genst the cross fence that runs not far from the barns and then running with that fence strate across till it strikes the upper line.

3'dly I give to my son William Fuller the balance of the above mentioned tract of land which I now live on with all my sole and personal estate excepting a comfortable maintanance out of the last mentioned part for my wife Sally during her lifetime or widowhood in the dwelling house I now live in such a maintanance as my son William and Johnson Howard my executor shall think sufficient also I give to my son William a certain tract of land lying on the north side of the Clinch River in New Garden known by the Shark tract or the value of it if my executor above mentioned can sell it to the satisfaction of my wife and my son William.

4thly I desire that my executor shall collect my debts and out of the same money which is due me I give my daughter Lucy fifty dollars and the balance of the money to be deposited in the lands of my wife and my son William to defray all nessceceray expenses or to be disposed of to their satisfaction.

5thly I give and bequeath all my estate both sole and personal in manner and form above mentioned to ___ unsold.

And lastly I do hereby constitute and appoint my friend Johnson Howard executor of this my last will & testament hereby revoking all other or former wills or testaments by me hereto made In witness whereof I have hereunto set my hand and affixed my seal this twentysecond day of February one thousand eight hundred and thirteen.

This instrument of writing was exhibited in court as & for the last will & testament of Henry Fuller deceased and proven by the oaths of James Willis and Abraham Fuller the witnesses thereto & ordered to be recorded. And on the motion of Johnson Howard executor therein named who made oath thereto and together with Abraham Fuller his security entered into and acknowledged their bond in the penalty of two thousand dollars conditioned as the law directs certificate is granted him for obtaining a probat of the said will in due form.
