I Jacob McGlothlin of the County of Russell and State of Virginia, do hereby make and publish this my last will & testament hereby revoking and making void all former wills by me at anytime heretofore made.

1st, I direct at my death that my just debts and funeral expeneses be paid, and as to my lands I am now disposing of all of it to my five sons by deeds which I hope will be full satisfaction to them and as to my personal property, money, bonds, debts, household & kitchen furniture, I dispose of the same as follows that is.

2nd, If my wife Elizabeth is living at my death I desire that she may take one horse beast, two cows, eight sheep, all of which is to be of her own choice which property & increase is to go to my son Henry McGlothlin at the death of my said wife. I also give to my said wife as her own, all the household and kitchen furniture and all the fowls and geese, the last mentioned articles such as household & kitchen furniture she may dispose of as she may chose.

3rd, The balance of all my personal property such as stock, money, bonds, debts that I may have at my death to be sold and equally divided between my eight daughters, that is the children of my daughter Frankey Ratliff, to the children of my daughter Patsy Vandike, and to my daughter Rachel Vandike, and to my daughter Rebecca Meadows, & to my daughter Betsy Vance, to my daughter Nancy Jackson, and to my daughter Polly Mutter, and to my daughter Sarah J. Richardson, all equal shares alike all equal. the facts are to be clearly understood in this my will that my five boys, Frederick, David, Wm., Alexander, & Henry is to have all my lands & I am now preparing to deed it to them with certain covenants and the eight girls above named or their children to have all my personal estate except as stated to my wife in the 2nd and 3rd article.

4th, I hereby constitute and appoint my two sons Frederick & Wm. McGlothlin executors of this my last will and testament, as my hand & seal this ___ day of Feb 1869.

At a court begun and held for Russell County at the Courthouse thereof on Tuesday the 7th day of Oct. 1879. The last will and testament of Jacob McGlothlin was this day produced in court and proved by the oath of E.D. Miller and E. Ferrell, two of the subscribing witnesses thereto and ordered to be recorded. And the executors therein named refusing to take upon themselves the execution of said will and Elizabeth McGlothlin the widow of said Jacob McGlothlin appeared in court by counsel and renounced her right to administer on said estate whereupon on motion of Wm. P. McGlothlin who took oath of an administation prescribed by law and entered into and acknowledged a bond in the sum of $800.00 as together with Benson Combs, and Charles Johnson as his securities conditioned according to law. A certificate is therefore granted him for obtaining letters of Administration with the will annexed on the estate of Jacob McGlothlin deceased.
