Executed 29 Feb 1804

I James Dyer of Russell County and state of Virginia do hereby make my last will and Testament in manner following that is to say; first I desire that out of my money my just debts and funeral expenses to be paid out of the money in hand and all that is owing to me and the balance if there be any left I give it to my son Elisha and Boldy and the living stock horse cattle so forth to be sold and the money arrising therefrom to be divided between Elisha and Boldy. Secondly I give a Negro girl named Suky to my daughter Sinna. Thirdly, I give negro boy named Luke unto my son William and Willy to be equally divided between them two and if they cannot agree for them to sell the Negro and divide the mony equal, Fourthly I give my bed, and furniture of the bed and posts and pewter to my son William my daughter Sinna to be equally divided between them two as they please save one big pott to William fifthly I giving of mine acres of my land to my daught Sinna the land to be down on the river joining a white walnut corner and running up the river for quantity Sixthly I give the remaine of my land whick is 196 acres to my son William and Willy giving William eighty four acres and half and giving to Willey one hundred and ten acres and half to be divided according to the quality and divided as they please and if they cannot agree John Fugit and Littleberry Robinson to divide it agreeable to the mention quantity and quality and they to abide to it. Seventhly, all the rest of my estate both real and personal of what nature or kind whatsoever it may be herein particularly disposed of, I desire may be equally divided among my seveal children as herein before named which I give to them their heirs executors Administrators and assigns forever. And Lastly I do hereby constitute and appoint my trusty friend John Fugate and (blank) executors of this my last will and Testament hereby revoking all other or former wills or Testaments by me heretofore made In Witness whereof I have hereunto set my hand & affixed my seal this 1st day of August one thousand eight and three
