I James Scott of Russell County and State of Virginia do make this my last Will and Testament, in manner following, that is to say:

1 I desire that all my just debts and funeral expenses be paid out of any monies belonging to my estate at my decease.

2 I give and bequeath to my wife Rebeckah Scott all my estate real and personal during her natural life, except as herein after named

3. I give to my brothers William Scott, John Scott and Joseph Scott and to my sisters Jane Christman and Eleanor Claypole each the sum of one dollar, and in case of their death the same is to be paid to their heirs or legal representatives.

4. I desire that after the death of my wife Rebeckah, all my slaves, to wit, Charles, Philis, Hannah, and Celia and Charles the children of the said Hannah and any other children which the said Hannah or her increase may have borne or may be great with have and enjoy their freedom, and I do hereby forever, from and after that period emancipate them and every of them, from my heirs and from every other person.

5 I give and bequeath to my said slaves after their freedom as aforesaid all and singular my lands and tenaments goods and chattels, as follows: I desire that the said Charles shall have, hold and enjoy the East end of my lands as far as the orchard fence by a line running with the same fence one side to the other; and that the said Philis and Hannah and said Hannah's children and their increase have hold and enjoy the residue of my lands - all which lands lie in the County of Russell on the waters of Cedar Creek. My personal estate if any should remain, together with my farming utensils, and all my stock, I desire may be equally divided between the said slaves and their increase or such of them as may then be living.

6. I hereby constitute and appoint Wilson Browning and John Burk of the County of Russell executors of this my last Will and Testament, hereby revoking and annulling all former wills by me made; declaring this, and no other to be my last Will and Testament.

In witness whereof I have hereunto set my hand and affixed my seal the 9th day of September in the year of our Lord one thousand eight hundred and twenty two.

This instrument of writing was exhibited in court as and for the last Will and Testament of James Scott deceased and proven by the oaths of James Elliott Francis Browning and John Browning the subscribing witnesses thereto and ordered to be recorded. And on the motion of Wilson Browning and John Burk executors therein named who made oath and together with John Browning, David Munsey, James P. Smith and Crabtree Price their securities entered into and acknowledged a bond in the penalty of $5,000 conditioned as the law directs, certificate is granted the said Wilson Browning and John Burk for obtaining probat of the said will in due form
