Executed 05 Oct 1824

I James Wallis of the Russell County and State of Virginia, do hereby make my last will and testament in manner and form following that is to say: 1st, I desire that so much of the perishable part of my estate be immediately sold after my decease and out of the monies arising therefrom all my just debts and funeral expenses be paid. Should the perishable part of my property prove insufficient for the above purpose then I desire that my executors hereafter named, may sell my house and lands lying in the county, state aforesaid and out of the monies arising threefrom pay and satisfy such of my just debts, as shall remain out of the sale of the perishable part of my estate.

2ndly, After the payment of my debts and funeral expenses, I give to my wife Mary Wallis a sorrell horse and to have maintenance from my farm, and the use of my house during her widowhood or natural life.

3rdly, I give to my daughter, Susannah, which she now has in possession, one bed and furniture, a cow and calf, one oven and one flax wheel.

4thly, I give to my daughter Margaret, which she now holds in possession, except one oven, one bed and furniture, one cow and calf, one oven and flax wheel.

5thly, I give to my daughter Jane, one bed and furniture, one cow and calf, one oven and flax wheel.

6thly, I give to my daughter, Nancy Lea, one bed and furniture, one cow and calf, one oven and flax wheel. The furniture of the beds I give to my daughter shall be equal to the furniture of the bed I give to my daughter, Susannah.

7thly, After the decease of my wife I desire that my land and other property remaining shall be equally divided among my three sons, William, Logan & James.

8thly, I give to my son James my bright bay mare.

And lastly, I do hereby constitute my two sons William and Logan executors of my last will and testament hereby revoking all other or former wills or testaments by me heretofore made.

In witness whereof I have hereunto set my hand and affix my seal the 16th day of Sept. 1824.

At a Court held for Russell County on the 5th day of October 1824
This instrument of writing was exhibited in Court as and for the last will and testament of James Wallis deceased and proven by the oaths of John Fletcher and James M. McFarlane the subscribing witnesses thereto and ordered to be recorded. And on the motion of William Wallis and Logan Wallis Exec. therein named, who made oath, and together with John Fletcher, Henry Fuller and Samuel Bromley their securities entered into and acknowledged a bond in the penalty of $500 conditioned as the law directs, certificate is granted the said William Wallis & Logan Wallis for obtaining probat of the said will in due form.
