Executed 07 May 1895

I John Wyatt of the County of Russell and Stae of Virginia, being of sound mind and memory do make and declare this to be my last will and testament hereby revoking all other or former wills by me made.

1st, After the payment of all my just debts and funeral expenses I give to my Son-in law Patton May the sum of five hundred dollars out of the proceeds of the sale of my land which shall be in full of all claims that he may hold against me and in full of his wife Labelle, interest in my estate.

2nd, I give to my daughter Mary A. Ashbrook the sum of ten dollars.

3rd, I hereby recognize my son Joseph Duff and I give to him the following property the Marebird by name, and her yearling col, and two cows, two beds with the clothing, and steads, and my shot gun, and watch. I request him of his own free will to assume the name Joseph Wyatt as a mark of his regard for me.

4th, I desire my wife Margaret Wyatt and my Daughter Jane to remain together and I give to them equally all my household and kitchen furniture not hereafter disposed of, and I give to my wife individually the remainder of my personal property, and enough out of the proceeds of the sale of my lands, to make her interest equal to one third of my estate, and the remainder if any I give to my daughter Jane.

5th, I direct my Executor to collect the money due me for the sale of my land to John G. Matthews and apply it agreeable to the provisions of this will and when the terms of the sale of the land agreeable to the title bond held by said Matthews is complied with by Matthews, I direct that he my Executor, convey jointly with my wife, the title to Matthews as required by the terms of the title bond when the purchase money is paid in full.

6th, I hereby constitute John T. Howard Jr. My Executor of this my last will and testament. Witness my hand and seal this 18th day of April 1895.

The above and foregoing written will was acknowledged by John Wyatt in our presence to be his last will and testament and at his request we subscribe our names as witnesses to the same this 18th day of April 1895.

At A County Court begun and held for Russell County at the Courthouse thereof on Tuesday the 7th day of May 1895. The last will and testament of John Wyatt deceased was this day produced in court and proven by the oath of John P. Wilson one of the subscribing witnesses thereto who testified that he witnessed said will at the request of the testator and in his presence and in the presence of Robert M. Barrett the other subscribing witness thereto whereupon said will was admitted to probate and ordered to be recorded in due form.
