I, J. M. Ferguson, being of sound mind and disposing memory, do make and publish this my last Will and testament, in the words and figures following, towit:
First: I give and bequeath to my children and the children of any that may be dead at the date of my death, except Evert Bruce Ferguson, Kent Banner Ferguson and Jennett M. Price all my estate, both real and personal, to be divided equally between them. But the said Evert Bruce Ferguson, having been paid his part of my estate, by me and same being equal to each of my other children, I give him nothing more, also Kent Banner Ferguson and Jennett M. Price, I give them nothing more.
Second: I give to my wife one third of my personal property and also give her one third of my real estate for life, and her one third of real estate shall include the mansion house I now live in.
Witness the following signature and seal this the 17th day of February, 1930.

Virginia: In the Clerk's Office of the Circuit Court of Russell County, the 29th day of April, 1930. A paper writing purporting to be the true and last will and testament of J. M. Ferguson, deceased, was this day produced in the Clerk's office aforesaid, before the clerk of the said Court and proven by the oath of T. A. Gilmer, and A. A. Ferguson, to be wholly written in the handwriting of the testator, J. M. Ferguson, and it appearing that neither of said witnesses are in any ... interested in the proceeds of the estate of said J. M. Ferguson, thereupon said will was admitted to probate and ordered to be recorded as and for the true last will and testament of the said J. M. Ferguson, deceased.

The undersigned, who qualified on the 29th day of April, 1930 in the County of Russell as Admr. of J. M. Ferguson, late of said county on my oath do say that I have made diligent inquiry as to the names, ages and addresses of the heirs of my decedent, J. M. Ferguson, and I believe the following to be a true and correct list of such heirs with their ages and addresses.
