Executed 05 Nov 1822

In the name of God Amen. I Mary Smith of the County of Russell being sick and weak in body but of sound mind and disposing memory, (for which I thank God) and calling to mind the uncertainty of human life and being desirous to dispose of all such worldly estate as it hath pleased God to bless me with, I give and bequeath the same in manner following, that is to say:

1st. I desire that all the perishable part of my Estate be immediately sold after my decease and out of the monies arrising therefrom all my just debts and funeral expenses be paid

2d. I desire that Elizabeth Strother the widow of my son Jas Strother enjoy all the land I purchased of Mr Charles Holliday during her widowhood, and afterwards to my grand son James Strother, to be enjoyed by him and his heirs forever

3dly As I have already given all that I wish to give to my daughter Mary Fickler I desire that she may not claim any more of my estate

4thly I give to my daughter Elizabeth Green the sum of five hundred Dollars in cash as and for her full share, part and proportion of my estate, in addition to what she has already received, to be paid out of the proceeds of my personal property and such debts as may be due to me at my decease

5thly All the rest of my estate of what nature or kind soever it may be not herein particularly disposed of I desire may be equally divided between my daughter Sally Taylor, my son Harry Smith and my daughter Eeggy Smith to be enjoyed by them and their heirs forever

6thly I desire that my estate may not be appraised

And lastly, I do hereby constitute and appoint my son-in-law James Taylor and my son Harry Smith or either of them executors or executor of this my last will & testament hereby revoking all other or former wills or testaments by me heretofore made. In witness whereof I have hereunto set my hand & affixed my seal this 14th day of Jan. 1819.

This instrument of writing was exhibited in court as and for the last Will and Testament of Mary Smith deceasedd and proven by the oaths of Daniel Horton and Travis Kendall two of the subscibing witnesses thereto and ordered to be recorded.
