I, William Burk, of Russell County & State of Virginia, do hereby make my last Will and Testament in manner and form following, that is to say:
1st. I desire that as much of the perishable part of my estate be immediately sold after my decease and out of the moneys arising therefrom all my just debts & funeral expenses be paid.
2nd. After the payment of my debts and funeral expenses I give to my wife Rebecca one third part of my estate both real and personal, with the exception of black boy Ben which is to be sold when his daughter Susan comes of age and the money arising therefrom to be divided equally among my heirs, and Aaron the other black boy to remain with my wife during her natural life and after her decease to be sold and the money arising from to be equally divided among the heirs equally and all the rest of my estate both real and personal of what nature or kind soever its may be not herein before particularly disposed of I desire may be equally divided among my several children all the household furniture to remain with my wife to dispose of as the children leave home and lastly, I do hereby constitute, and appoint my friends Archable Burk and Thomas S Johnson executors of this my last Will and Testament hereby revoking all other or former wills or testaments by me heretofore made. In witness whereof I have hereunto set my hand and fixed my seal, this 23 day of January in the year of our Lord 1850

At a Court of quarterly session held for Russell County at the Courthouse on Tuesday the 5th day of March
1850.
This Instrument of writing was exhibited in Court as and for the last Will and Testament of William Burkdeceased, and proven by the oaths of John H. Gardner and George W. Johnson the subscribing witnesses
thereto, and ordered to be recorded. And on the motion of Thomas S. Johnson and Archer Burk executors
therein named who made oath, and together with Robert Burk and William Browning their securities, entered
into and acknowledged a bond on the penalty of $5000.00 conditioned as the law directs, certificate is granted
them for obtaining probate of the said Will in due form.
