Will of Shadrack Bush 1826

The Last Will and Testament of Shadrack Bush [Jr.] of Baltimore Co., Dated 9 June 1826

In the name of God Amen! I Shadrack Bush of Balto Cty. the state of Maryland being sick and week in body but of sound and disposing mind memory and understanding, considering the certainty of death and the uncertainty of the time thereof and being desirous to settle my worldly affairs and thereby be the better prepared to leave this world when it shall please God to call me hence do therefore make and publish this my Last Will and Testament in manner and form following, that is to say; First and principally I commit my soul into the hands of the Almighty God, and my body to the earth, to be decently buried at the discretion of my executor herein after named, and after my debts and funeral charges are paid. I give devise and bequeath as follows;

Item, I give and bequeath unto my two sons John and Benjamin my dwelling plantation and all my land in the state of Maryland to be equally divided between them, share and share alike. And also all my stock and farming utentials together with all my carpenters and blacksmiths tools, and all my household furniture as is herein after devised. And it is my will that my aforesaid dwelling plantation, and lands, and all my stock, farming utensils, and household furniture except such parts as are herein after devised and bequeathed shall not be divided during the natural life of widowhood of my wife but that she shall have an equal share and inheritance of the same with my aforesaid son's John and Benjamin, during her life or widowhood aforesaid. And it is my will that my four daughters shall have a home in my dwelling house while they remain unmarried, industrious and behave with propriety and decorum.

Item, I give and bequeath to my son David ninety acres of land lying in the state of Ohio, Choshockton Cty. NE Quarter, section 4, in township 5.

Item, I give and bequeath to my daughter Sarah 56 acres of land lying in the state of Ohio, Coshockton Cty. adjoining to and being part of that quarter a part whereof, is herein devised to my son David and so to be laid off as to include a part of the Thugar Camp and a proportional value with David's part.

Item, I give and bequeath unto my son Daniel and my daughter Rhoda all my tract of land lying in the state of Ohio, Coshockton Cty, being a NE Quarter, Section 24, Township 5, Range Nine to be divided between them as follows, Rhoda shall have 60 acres and Daniel the remaining according to quality and quantity.

Item, and whereas I have deposited two hundred dollars in the hands of a certain John Culison to purchase lands in the state of Ohio for me, and it being certain whether such purchase has been made - it is my will that if such purchase has been made it shall be equally divided between my two daughters Kesiah and Elizabeth share and share alike - and if no such purchase has been made then the aforesaid sum of two hundred dollars shall be equally divided between them.

Item, I give and bequeath unto my four daughters, Sarah, Rhoda, Kesiah, and Elizabeth, eight hundred dollars to be equally divided among them in manner and form following, after my death the said sum of eight hundred dollars shall be put out to interest on bond with good securities by my executor and the profits arising therefrom to be applied to the principal until they shall arrive at the age of nineteen years respectively, there as they arrive at the age aforesaid they shall be entitled to their respective shares of the profits thereof until they shall arrive at the age of twenty-six years and then they shall be entitled to their respective shares of the aforesaid sum of eight hundred dollars with the profits as aforesaid and if either of my aforesaid daughters shall happen to die or decease without issue born under wedlock, before they arrive at the age of twenty-six years as aforesaid then and in that case her share, or their shares so dying shall descend to the surviving sisters.

Item, I give and bequeath unto my son Daniel the sum of forty dollars current money. Item, I give and bequeath unto my daughter Sarah one feather bed and furniture. Item, I give and devise unto my daughter Rhoda one feather bed and furniture. Item, I give and devise or bequeath unto my family all the crop of, whatever kind it may be that now is or may be growing on my dwelling plantation at the time of my decease and all the grain, whether thrised or otherwise for their support generally.

Item, I give and bequeath unto my son Daniel all the remainder of my estate real or personal to him, his heirs, and assigns forever. And lastly, I do hereby constitute and appoint my friend John May to be sole executor of this my Last Will and Testament, revoking and annulling all former wills by me heretofore made. Ratifying and confirming this and none-other to be my Last Will and Testament. In testimony whereof I have hereunto set my hand and affixed my seal the ninth day of June in the year of our Lord One thousand Eight Hundred and Twenty Six.

Note: The above is a transcription of the version that was hand copied and sent me (Martha Bush-Blocker) by Deborah Schaeffer, also Linda Goss and L. Spencer Leister found this will. Shadrach's Last Will and Testament, dated 09 June 1826 was presented for probate in 12 Aug. 1826. Shadrach, the only child of Sara (Osborn) and Shadrack Bush, Sr. was born on 23 March 1768 in Baltimore County, MD. Shadrach BUSH and Magdalene BROWN were married in about 1799. Magdalene BROWN was born 02 Feb 1771, her death was on 16 Oct 1846. Magdalene and Shadrack BUSH, Jr. had eight children.
