Will of Eleanor Ensor 1799

Last Will and Testament of Eleanor ENSOR of Baltimore county, Dated 7 December 1799, Codicil Dated 15 August 1801, Proved 10 October 1801

In the Name of God Amen I Eleanor Ensor of Baltimore County and State of Maryland being in perfect mind and memory, Do make and ordain this my last Will and Testament in manner and form following viz. First my Just debts and funeral(?) charges be paid by my Executor hereafter named. ---

Item I give and bequeath unto Nicholas Merryman Junr. his heirs and assigns forever all that parcel of Land lying in the County af'd. and on the south side of the Western Run containing three Hundred and forty acres more or less, being part of a Tract of land called the Shawan hunting ground and now in the possession of the said Nicholas Merryman.---

Item I give and bequeath unto my Grand Daughter Elizabeth Kenter my chest of Drawers, and ten pounds current money in Specie to her and her heirs.----

Item I give and bequeath unto my Grand Daughter Eleanor Merryman daughter of Mary Merryman deceased one Looking Glass and ten pounds Current Money in Specie, and one black trunk to her and her heirs

Item I give and bequeath unto my grandson Moses Merryman ten pounds Current money in Specie, to him and his heirs ---

Item I give and bequeath unto my Grandson Micajah Merryman (son of Micajah Merryman) ten pounds Current Money in Specie to him and his heirs.---

Item I give and bequeath to my Grandson Nathanial Griffith ten pounds Current Money in Specie to him and his heirs.

Item I give and bequeath unto my two Grand Daughters Mary Merryman and Sarah Merryman (Daughters of my Daughter Mary dec'd) ten pounds each in Specie to them and their heirs ----

Item I give and bequeath unto my Grand Daughter Eleanor Merryman (Daughter of Nicholas Merryman) my feather bed and furniture thereunto belonging ??? my plate(?) to her and her heirs -----

Item I give and bequeath unto my friend Robert North Carnan twenty pounds in Specie to be applied as he may deem good to the relief of the poor belonging to the Methodist Society. ---

Item I give and bequeath the residue of my Estate to be divided in the following manner viz one fourth part thereof to Rachel Hyde Elizabeth Kenter, and Nathanial Griffith, being the Children of my Daughter Elizabeth Griffith Dec'd and that Nathaniel Griffith part remain in the hands of Micajah Merryman to be paid him when at age. ---- One fourth part to my two Grandsons John Merryman and Nicholas Merryman (sons of my Daughter Francis Merryman Deceased) to them and their heirs. ---- One fourth part of Sarah Merryman, Moses Merryman, Eleanor Merryman, Mary Merryman, and Micajah Merryman (Children of my Daughter Mary Merryman Deceased) to be equally divided between them and their heirs ---- The other one fourth part to John Merryman, Elijah Merryman, Micajah Merryman, Eleanor Merryman and Nicholas Merryman (Children of my Daughter Deborah Merryman deceased) to be divided between them and their heirs ---

And be it further remembered that whereas George Risteau Deceased did become security in the Commiss ..?. Ofice for Nathan Griffith as administrator of my deceased Husband John Ensor and that the Estate of the said John Ensor remains unsettled. To save and keep harmless ?? of the afs'd George Risteau, my will and desire ..?. ..?. in case any of my Legatees before mentioned or any ..??.. or persons for them shall claim any sums or ..?.. from the heirs of the afs'd George Risteau on account ..??.. any Deficiency that may remain due of the Estate of my husband John Ensor afs'd that my Executor hereafter Named withold such legacy or legacys from the Legatees afs'd all that part of my Estate bequeathed to them until the heirs of John Ensor Deceased afs'd give the heirs of George Risteau afs'd a full discharge in writing under their hands from any further claim on acct. of the Estate of my Husband John Ensor afors'd Provided the heirs of Thomas Risteau Deceased releace to my Executor (for the use of my Grand Children aforesaid) a mortgage which he the said Thomas Risteau obtained from Nathaniel Griffith for a parcel of Land in Potapsco Neck and also for the furniture mentioned therein, --

Lastly I do hereby nominate and appoint Micajah Merryman my whole and sole Executor of this my last Will and Testament revoking all heretofore by me made In Witness whereof I have hereunto set my hand and affixed my seal this seventh day of December in the year of our lord one Thousand Seven Hundred and Ninety Nine ---

Baltimore County to wit
on the 10th day of October 1801 came Rob't N'th Carnan Christian Carnan and John Butler Subscribing Evidences to the aforegoing last Will and Testament of Eleanor Ensor late of said County deceased and made oath Etc. that they did see the Testatee(?)  ..?.. will that they heard her publish pronounce and decl.??.. same to be her last will and Testament that at the time of her so doing she seemed to the best of their apprehension to be of sound disposing mind memory and understanding and that they Subscribed their names as witnesses to this will in her presence and at her request and in the presence of each other before me Register of wills for

Whereas since the making of the above last Will and Testament of me the above named Eleanor Ensor, one of my grandsons John Merryman (one of the sons of my Daughter Francis Merryman deceased) hath departed this life, now I the said Elinor Ensor do hereby bequeath and devise to his Brother Nicholas Merryman his heirs Executors and Administrators the one fourth part of the residue of my said Estate. .?. I had by my said last Will and Testament given to the said John Merryman deceased and to the said Nicholas Merryman and their heirs, he paying to Eliza Heidie my Great Grand Daughter, the sum of ten pounds Current Money, it being my intention that the said Nicholas Merryman should have the whole of the said fourth part, subject to the payment of the sum aforesaid And I do will and direct that this may be deemed and taken as a Codicil to my above last Will and Testament and do in all things, not hereby altered, Confirm and ratify the same , In .?.. whereof I have hereunto set my hand and seal this fifteenth day of August 1801. ----
