Will of John Mays Senr. of Baltimore Co. dtd 1860

In the name of God Amen, I John Mays Senr of Baltimore County in the State of Maryland, being weak in body but of Sound and disposing mind, memory, and understanding and considering the certainty of death and the uncertainty of the time thereof and being desireous to settle my worldly affair and thereby be the better prepared to leave this world when it Shall please God to call me hence to therefore make and publish this My last will and testament in manner and form following, that is to say.

First and principally I committ My soul into the hands of Almighty God and My body to the earth, to be decently buried at the discretion of my Executor hereinafter named, and after My debts and funeral Charges Are paid I devise and bequeath as follows:

Item. I give and devise unto My son Thomas G. Mays all my Estate both real and personal (out of which he is to pay the following legacys to the following named persons) the above devise of real estate to him the Said Thomas G. Mays his heirs and assigns in fee Simple.

Item. I give and bequeath unto my daughter Elizabeth Ann Miller wife of Robert Miller the sum of Six Hundred Dollars.

Item. I give and bequath unto my daughter Rachel G. Miller, Wife of Stephen Miller the sum of Six Hundred Dollars.

Item I give and bequeath unto my son John P. Mays the sum of two hundred dollars.

The aforesaid legacys to be paid by my son Thomas G. Mays to the aforesaid legatees within three years after my decease. and lastly I do hereby constitute and appoint My sons Thomas G. Mays and John P. Mays to be Sole Executors of of this my last will and testament revoking and anulling all former wills by me heretofore made. ratifying and confirming this and none other to be My last will and testament in testamony where of I have Persented Set My hand and affixed My Seal this ___ day _______ in the year of our Lord one thousand Eight Hundred and Sixty.

Signed Sealed published and declared by John Mays Senr. the above named testator as and for his last Will and Testament in the presence of us who at his request in his presence and in the presence of each other have subscribed ournames as witnesses thereto:

Baltiomore County SS. On this 13th day of October 1868 came William G. Almony Subscribing witness to the aforegoing Last Will and Testament of John Mays Sr. late of said County deceased, and made oath on the Holy Evangely of Almighty God that he did See the Testator Sign and Seal this will that he heard him publish, pronounce, and declare the same to be his Last Will and Testament that at the time of his so doing he was to the best of his apprehension of sound and disposing mind, memory, and understanding, andthat he together with B. A. Price and Samul D. Price Subscribed their names as witnesses to this will in his presence at his request, and in the presence of each other Sworn to in Open Court. Test. O. P.
