Will of Samuel Ward 1864

Last Will & Testament of Samuel Ward of Baltimore co., Dated 20 Jan 1864, Proved 6 Aug 1867

Know all men by these presents that I Samuel Ward of Baltimore County in the State of Maryland being in good health and of sound and disposing mind and memory do make and publish this my last will and testament hereby revoking all former wills by me at any time heretofore made and as to my worldly estate and all the property real personal or mixed of which I shall die seized and possessed or which I shall be entitled at the time of my decease I devise bequeath and dispose thereof in the manner following to Wit:

First my will is that all my just debts and funeral expenses shall by my executor hereinafter named be paid out of my estate.

Item I give devise and bequeath to Mary Craig daughter of my brother William Ward Five hundred dollars to her, her heirs and assigns.

Item I give devise and bequeath to William Gosnell, son of my nephew Philip Gosnell Five hundred dollars to him, his heirs and assigns.

Item I give devise and bequeath to James Burnsides, son of my sister Ann Burnsides Five hundred dollars to him, his heirs and assigns.

Item I give devise and bequeath to my sister Sarah Boring Five hundred dollars to her, her heirs and assigns.

Item I give devise and bequeath to Sarah Ann Stanfield, daughter of my sister Rachael Cook Five hundred dollars to her, her heirs and assigns.

Item I give devise and bequeath to Mary Winsor, daughter of my sister Elizabeth Simmons Five hundred dollars to her, her heirs and assigns.

Item I give devise and bequeath to Rachael Randall, daughter of my brother John Ward Five hundred dollars to her, her heirs and assigns.

Item I give devise and bequeath to Sarah McFarland daughter of my niece Julianne Randell Five hundred dollars to her, her heirs and assigns.

Item I give devise and bequeath to (Rachael) Ward daughter of my brother Joseph Ward Five hundred dollars also ( ) bed bedstead and best bedding also one ( ___________________ ) one ( ) table and __ dozen the best chairs to her, her heirs and assigns.

Item I give devise and bequeath to Margaret Vaughn wife of John P. Vaughn Five hundred dollars to her, her heirs and assigns.

Item I will and desire that the named sums of money or bequests be paid to the aforementioned legatees by my executor to be named, within one year after my death out of money or stock that may come into his hands or by the sale of my said estate it is my will and ( ) that my real estate be bound for all legicies left by me.

Item I give devise and bequeath to Lemuel W. Gosnell in trust for Vinton Stanfield Five hundred dollars to be invested by said trustee for the benefit of the said Vinton Stansfield until he shall become the age of twenty one years to him his heirs and assigns the above named Vinton Stansfield being the grandson of my sister Rachel Cook.

Item I give devise and bequeath to Lemuel W. Gosnell in trust for Samuel Belt son of my niece Susannah Belt Five hundred dollars to be invested by said executor for the benefit of the said Samuel Belt until he shall become of the age of twenty one years to him, his heirs and assigns.

Item, I hereby appoint Lemuel W. Gosnell trustee for William Gosnell to take charge of Five hundred dollars the amount of the legicie left him by me and invest the same for his benefit until he shall become of the age of twenty one years.

Item I give devise and bequeath to my friend Lemuel W. Gosnell after the aforementioned legicies shall first have been paid or satisfied all the ballance of my real ( ) and mixed estate.

And lastly I do hereby constitute and appoint my friend Lemuel W. Gosnell to be sole executor of this my last will and testament revoking and annulling all former wills by me therefore made, satisfying and confirming this and none other to be my last will and testament. In testimony whereof I have hereto set my hand and affixed my seal this twetieth (sic) day of January in the year of our Lord eighteen hundred and sixty four.

Signed, sealed, published and delivered by the said Samuel Ward as _____ for his last will and testament in the presence of us who at his request and in his presence and in the presence of each other have subscribed our names as witnessed thereto.

Baltimore County: the 6th day of August 1867 came Lemuel W. Gosnell and made oath on the Holy Evangily of Almighty God that he doth not know of any other will or codicil of Samuel Ward late of said county deceased other than the above instrument of writing and that he found the same among the papers of deceased in his desk on or about the 1st day of July 1867. Sworn in open Court.

Baltimore County on this 6th day of August 1867 came Sam'l P. S ____, Edward O Dell and Jesse W. Dell subscribing witnesses to the aforegoing last will and testament of Samuel Ward late of said county deceased and made oath on the Holy Evangily of Almighty God that they did see the testator sign and seal this will, that they heard him publish _____ and deliver the same to be his last will and witnessed that at the time of his so doing he was to the best of their apprehension of sound and disposing mind memory and understanding and that they subscribed their names as witnesses to this will in his presence at his request and in the presence of each other. Sworn to in open Court.
