Some of the listings are quite informative and may provide family members of three generations or more. These cases brought before the judge consisted of sworn testimony and each one holds a story. Martha M. FOUT by her husband Cyrus A. FOUT - Division of Real Estate - #4779 - Mar 1882 William H. RAMSBURG d/ c1880, intestate widow - Catharine Rebecca (life estate) d/ Martha M. (Ramsburg) w/o Cyrus A.FOUT d/ Fanny (Ramsburg) RUPLEY One half of Estate In trust to Thomas GORSUCH and Thomas M. MARKELL for benefit of his daughter Fanny RUPLEY. The other half, also in trust to them, for benefit of his daughter Martha RAMSBURG. If one of the daughters die without issue, then her share to the other daughter. Exec/ wife Witnesses: W.J. ROSS, Thomas CLAGETT, Thomas N. HARWOOD [Will JRR-1, 526; written 9 Nov 1875; filed 8 Jun 1880] The trustees refused to act on the trust. New trustees appointed were Cyrus A. FOUT and John S. RAMSBURG; however, RAMSBURG declined, so was then replaced by Charles J. LEWIS (he was representing Mrs. Fanny RUPLEY; Equity #4786). Cyrus A. FOUT sold a portion of the real estate (Equity #4919) at $725; after expenses, the balance remaining was $525.73. LAND - "Shever Stadt" and "Carroll Creek", 101-acre Farm near Frederick City; both were part of "Tasker's Chance". Improved with a small weatherboarded log house and small brick stable. Land was surveyed for Division: Plat on page 12 - FOUT Lot #1 - 47 acres of "Shever Stadt" on Hagerstown Turnpike, separated from the other part by a field of Mr HOPWOOD. - RUPLEY Lot #2 - 54 acres of "Carroll Creek", included road to other properties and some of the land is at times flooded by the waterway, but leaves about the same tillable land. Provision for FOUT to remove the log tenement house, as there were two houses on this section, but none on the other lot. Land was conveyed to Peter RAMSBURG from John RAMSBURG, trustee, in Mar 1838. Edward SNOWDEN vs Margaret WARNER & h/ Eldridge WARNER - Sale of Real Estate - #7329 - Feb 1903 Edward SNOWDEN had been living in Frederick County for the past 2 1/2 years. In 1890, when he was 18 years old and living with his maternal grandmother, Elisa Syrus, he was assaulted and despicably used by Samuel CLAGETT, now deceased. He had filed charges and recovered $400 from Clagett, paid to Joseph SYRUS in trust for the use of Edward, because Edward was still a minor. Joseph SYRUS was of no relation to him, but was the husband of his maternal grandmother, Eliza SYRUS. Edward was the grandson of Chambers CYRAS or SYRUS. Joseph used $220 of this money to pay off a mortgage and spent more of this money on improving and adding to this property. Joseph SYRUS died July 4, 1894, leaving a widow Eliza who died in 1901, and his only child, a daughter Margaret, the wife of Eldridge WARNER. Joseph's name was spelled CYRAS, SYRUS and SIRUS, but he was also known as Joseph CHAMBERS. The property has never been conveyed and Joseph was a laboring colored man, entirely without means, thus no administration was ever taken out on the estate. GAITHER purchased a piano and organ, held as tenants in common. Since the death of Peter LUGENBEEL, the note for these was paid, 1/3 by each, Peter's share paid by his executor, Calvin S. URNER. [Will JKW-1, 401] Rachael WARNER claimed Peter LUGENBEEL made a gift to her for his 1/3 interest in the piano, but claim was disputed. George D. NORRIS, a brother-in-law to Rachael WARNER, supported her claim and advertised the sale for the piano and organ without consent of Peter's executor. William M. GAITHER had died by 24 Apr 1896; admin/ Thomas H. GAITHER. None of the papers were recorded in this book, only notations they had been filed; including testimony, summons, opinions of the court and even the Report of Sale.
