Columbus Jr's estate then descended to his daughter 
Eleanor HINCKLEY and granddaughter Louisa Courtney O'DONNELL.

* Petition is to sell 'Mount O'Donnell' because it can no 
longer be managed.
An agreement to convey the farm has been made by Eleanor 
and her husband, but court appoval is needed for Louisa 
who is a minor; agreement to sell to:

William BRENGLE & wife of Henry Co, Virginia conveyed his share 
to Francis BRENGLE in Oct 1880 [AF-2, 659].

In Mar 1883, Maria, Francis and Annie BRENGLE conveyed the north 
part of the western half of Lot #113, fronting West Third St in 
Frederick City at $1,150 to:

In 1889, Annie BRENGLE died, her share then to her two brothers.

On Jun 25, 1889, William D. BRENGLE filed Equity #5577 for 
writ of lunatico inquirendo for soundness of mind on his brother 
Francis.  Court appointed William as his trustee.

In Sep 1893, Maria BRENGLE, the widow, died, devising her share 
to her son William D. in trust for son Francis. (Wm. D. as exec)
[Will JKW-1, 121; 17 Feb 1890; 3 Oct 1893].
She had lived on the western half of Lot #113 on Second St.
Francis was now in possession of 5/8; William D. had 1/8 and 
the other 1/4 was held in trust.

William D. BRENGLE sold Francis' shares of the lot to:
- G. Warring TYSON at $4,300 [Equity #6577]
  ($800 paid in Cash, $3.500 mortgaged)
   Described as being on north side of West Second St in Frederick 
   City and east of residence of the widow of G. Joseph DOLL
   in Sep 1896 [Deed JLJ-14, 357]  (But 1/4 was still in trust)

William D. BRENGLE then moved his brother Francis to Virginia 
to live with him.  Francis died in early 1900.

in trust; however, when the property was sold to G. Warring TYSON, 
he believed he had purchased all of the interest in said property; 
thereby requesting, if 1/4 share to be sold, he may be allowed the 
proceeds as he has paid interest on mortgage during this time.

Trustee for the sale was John S. NEWMAN. 
Private sale was made to G. Waring TYSON at $850.

A former contract issued the 1/4 share in trust was to be 
invested separately from the real estate.
There was $7,000 invested in Virginia Century Bonds and was 
originated by Dr. William D. BRENGLE of Ridgeway, Henry Co, 
VA, trustee for Francis BRENGLE, in custody of Farmers & 
Mechanics National Bank.

Court issued proceeds of sale to G. Waring TYSON and the bonds 
held in trust at Farmers & Mechanics National Bank be issued to 
the trustee; the two daughters of William D. BRENGLE being the 
only heirs of his brother Francis.

Eleanor and John L. HARDING both died between Aug 1832 and 
Oct 1839.  Eleanor died first and then her brother Casper MANTZ 
took charge of her children and provided for them, although they 
were boarded out, he provided for their scholing and maintenance. 
He lived alone in his mansion.

After Casper MANTZ died, John H. McELFRESH took possession 
of everything, being executor; but no longer provided any 
funding for the children of Eleanor & John L. HARDING, nor 
did he invest the $15,000 of their legacies, but had kept 
everything for himself.  He also had not sold the property, 
but continued to take possession of it and benefit from the 
proceeds of the crops.

The Theresia McELFRESH disputed the claims and stated her 
husband had provided for the HARDING children and kept a 
record of it.  She also claimed no liability for any claim 
by the HARDING children.  Also claimed ownership of additional 
real eastate: 

- "Belview" and parts of Lots #4-6 of "The Resurvey on Locust 
Level", totaling 110 acres in Frederick Town; on road from 
Baltimore to Frederick Town; adjoined land of Abraham 
SCHRIVER and 'Fulling Mill Road'. 
- "Belview" and part of Lot #7 of "Resurvey of Locus Level", 
   20 acres.
Totals 130 acres.
To Caspar MANTZ from Joseph KENAGA & w/ Margaret of 
Berks Co, PA at $8,480 in Mar 1835 [JS-48, 354].
(Purchased after Caspar had written his Will).

Testimony was heard 13 Jan 1843 from: 
- Normond B. HARDING; testimony only revealed he knew all 
  the parties in the case.

Trustee appointed was George M. EICHELBERGER, for Eleanor 
HARDING's children's trust real estate in trust to be sold. 
Sureties were Gideon BANTZ, John MARKELL, Isaac BAUGHER 
and Joserph WELTY; bond was $60,000.

William M. BEALL as guardian for McELFRESH children to 
convey deed.

Sale advertised in the The Citizen & Examiner, National 
Intelligence (Frederick) and in the Baltimore American 
and Frederick Herald for the farm.

SALE was held 11 Mar 1843 at Mr GILBERT's Tavern; 
high bidders were; 
- James M. HARDING for the 220-acre farm at $14,818
- Grafton HAMMOND for the five divided lots: 
  Lot #1, 20 acres, 2 roods, 24 perches, at $18/acre
  Lot #3, 20 acres, 1r, 48p, at $30.50/acre

Deed conveyed to George W. JONES from William J. KINDLY
& w/ Mary E. in Dec 1895 (after Sarah's death) (recorded??).

George W. JONES had claimed an interest in said property and 
claimed he was the purchaser and made the improvements at 
his expense.  He admitted some of Sarah's children had been 
living there, but he didn't feel they had any rights to the 
property.

William J. KINDLY claimed he agreed to sell the property to 
JONES and, although he received money from Sarah, he believed 
it was for the purchase to JONES. He also stated both JONES 
and Sarah had been living there.  He admitted the monies had 
been paid for the property and he had not conveyed a deed to 
anyone.

Trustees were Hammond URNER and John C. MOTTER.

George W. JONES petitioned to stop the sale of the property 
in Aug 1897.

- Georgie L. KEYSER, age 39, Frederick County; daughter 
  of Sarah PRETTYMAN; stated William KINDLY died about 
  8 years ago.
  Claimed "Nettie" uses the name CRAWFORD, but was never 
  married.
  Claimed her mother owned two acres, one mile from Urbana, 
  purchased from George SMITH (opposite side of road from 
  the other property).
  Claimed her mother had paid $70 of the purchase price of 
  the land claimed by George W. JONES and was where her mother 
  was living at her death.  She also stated her mother had paid 
  for the improvements with pension money from the US Government 
  for her father who was a soldier.
  Her mother had paid $107 for the wells, $73 for the land and 
  $400-$500 for the improvements.
  Her mother and George W. JONES had been living together for 
  15-20 years, but were never married.
  Besides her siblings, her grandparents had lived there until 
  they died.
  She was then living there with her husband and 6 children 
  and had been living there since her mother died in the Fall 
  of 1893.  She and her family was living in four of the rooms 
  and George W. JONES occupied the other two rooms.
  She had herself witnessed her mother getting the pension 
  money from the bank and paying different people for the well 
  and other things.
  After her mother's death, the children and George W. JONES met 
  and discussed what was best.  Mr. JONES said it would be best 
  to take a life estate, as he was not able to repay the money 
  her mother had paid.

- Mrs Nannie YOUNG, age 34, near Urbana; lived across the road 
  from the deceased.  Albert KEYS was her brother-in-law.  
  Nannie lived in a shanty on the two acres across the road 
  with her husband and three children.

- Albert John KEYS, age 38, near Urbana, husband of Georgia.
  He and his wife had lived on the property.  When he was 
  working with George W. JONES, the latter told him he would 
  take a life estate and was all he wanted; said Georgia KEYS 
  was entitled to it because the money came from her father's 
  pension.

- Nathan J. ENGLISH, age 38, near Urbana, a neighbor.
  Improvements & additions to the property were made after 
  Sarah received the pension money.  Will HENDRICKSON, the 
  carpenter, told him Sarah had paid him.

- George W. YOUNG, age 44, Centreville, a neighbor.
  Improvements & addition to the property were made after 
  Sarah got the pension money.  George W. JONES had only 
  done two jobs that year and only earned about $35.  Jones 
  had told him he couldn't pay him, but he would get the 
  money from the old lady.  He heard Jones tell a neighbor 
  that he wasn't doing the improvements, Sallie was (Sallie 
  being Sarah PRETTYMAN).  He said Jones wasn't working 
  much after Sarah got the pension money, but the old lady 
  was going to set him up with a shoe shop.

- William HAMILTON (colored), age 73, near Urbana, half 
  brother of Sarah.

- Mrs. Annie Maria SMITH, age 50, near Urbana.

- Anthony K. WILLIAMS, age 49, Monrovia. 
  Stated JONES was a fence maker.

- John T. DIGGS, age 59, Urbana District.
  He had known JONES since boyhood and Sarah for 15 years; 
  JONES & Sarah had lived together 1-15 years.
     Claimed JONES had bought the land from KINDLEY and had 
  built the first house with logs from KINDLEY; the rest of 
  the supplies were bought in Frederick; Henry MEDARY 
  'put up' the house.  JONES was living across the road when 
  he bought this property and Sarah was living with him then.
  He claimed the house was built before Sarah got her pension 
  money, but didn't really know when she got the money.
     Mr JONES' attorney asked if Sarah had given her son Evan 
  money for a butcher business and son Cronin money to open 
  a store in Centerville. Claimed she had but questions not 
  relevant to monies paid for the property in question.
  Other people living on the property during this time were: 
     - Isaac RALLINS & wife who was a daughter of Sarah  
     - Peter GRAY (Sarah's father) & his wife Senie 
     - Eva GRAY
     - Cronin GRAY
     - a daughter of Sarah who died there
     - Cornelius, a son of Sarah (not George's son)
  Cross examination revealed John T. DIGGS could not provide 
  the year the house was built or the year Sarah received her 
  pension.  Improvements to house were: a kitchen, upstairs 
  and wasn't sure what else; hemlock was used.  The only way 
  DIGGS knew JONES had bought the house was because JONES 
  told him.

- George W. BRYAN, age 35, Centreville, about 50 yards from the 
  house in question.  He lived with William J. KINDLY from the 
  time he was 10 years old until KINDLY died in 1897 or 1898.  
  Claimed he saw JONES pay KINDLY money.  JONES had done 
  fencing work for KINDLY.
  After Sarah received her pension money, she bought the piece 
  of land across the road and an organ and paid $170 for this 
  2-acre lot and a horse and wagon.

- Lloyd THOMPSON, near Urbana. JONES started building the house 
  2-3 months after the purchase of the land.  JONES was a post 
  and nail fence maker.

- Georganna JONES, age 50, Centreville, widow of George W. JONES, 
  who died March 3, 1904, intestate, leaving a daughter, Florence 
  Sarah Ella JONES, now age 7.
 
George W. PETERS had claim, contracted with George W. JONES on 
Jan 10, 1897, for a coffin and funeral services for Cornelius 
JONES; a service of Sarah PRETTYMAN of $15; and the same on 
Jun 24, 1893 for coffin and funeral services and use of ice box 
for Sarah PRETTYMAN at $30.

Sarah received the pension in April or May 1885 of $2,100, as a 
widow of a deceased Federal Soldier, and monies were placed in 
the First National Bank.
Although JONES was a married man, there is little doubt he took 
up abode with Sarah PRETTYMAN and lived with her in the house 
now in question.
Although a deed was conveyed to JONES, it appears Sarah's money 
paid for the improvements and the lot, with maybe exception of 
$47 JONES paid as work done for KINDLY.

Court ruled for sale of the proprty and JONES' estate was to 
receive $47, with the balance of the proceeds to the heirs of 
Sarah PRETTYMAN.

Trustees were Joseph W. GAVER and Arthur D. WILLIARD, Esquire.
SALE was held 6 Aug 1904 at John R. HENDRICKSON's store in 
Urbana; high bidder was:

Houses are in need of repair and taxes due; however, Elizabeth 
HARRIS had no means to pay them.  Petition to sell the property.

Trustee was Frank L. STONER. 

Alton CARLIN petitioned to stop the sale.

Testimony was heard 29 Nov 1904 from: 
- John T. CARLIN, age 24, son, real esate broker, Baltimore 
  City; he moved from Frederick six years ago.
  The southern portion of the double house was occupied by John 
  STALEY; the roof was leaking and the plaster was falling off 
  in places and a number of windows were broken; the whole house 
  needs painting and carpenter repairs are needed on steps and 
  doors.  There are four years of taxes due on the property.
  The house is next to a saloon.

- Charles B. FOUT, age 50, Frederick City.
  Stated the property has been vacant for three months because 
  it is unfit to live in it. The roof is nearly off and it has 
  no windows, no cellar door and part of the kitchen is not 
  plastered and is in terrible condition. The last tenant was 
  Frank CRAMER.
  The tax collector said they would sell the house if the taxes 
  don't get paid. He was acting as rental agent for Mrs. HARRIS.

The court decided the property should be sold with Frank L. 
STONER still as trustee. Advertised in The Daily News.

SALE was held 4 Jan 1905 at the Court House; 
high bidder was:

   To mortgage $800 into a trust.
